Boating while Intoxicated (NH RSA 265-A:2)

Boating while Intoxicated (BWI), is similar to DWI, except the State does not have to prove you were on a public way. It is illegal to operate or attempt to operate a boat while under the influence of intoxicating liquor or a controlled drug or any combination of intoxicating liquor and a controlled drug or drugs, or while such person has an alcohol concentration of 0.08 or more or in the case of persons under the age of 21, 0.02 or more.

In New Hampshire, if you were arrested for BWI, you were likely stopped by Marine Patrol. Boating under the influence cases are very different than DWI cases in how the officer determines if someone is impaired to operate a boat. The field sobriety tests they administer are particularly different.
